Minutes of January 28, 2004 Shadow Wood Public Hearing were reviewed and amended as follows: Flipping the first two sentences in the first paragraph to read… Flynn introduced himself and the board members and asked Gary Weiner to start his presentation. Robert Majkut recused himself as he has business dealings with Mr. Lemieux owner of Shadow Wood property.

(1.) Special Permit Application for Billy Pope – East Longmeadow Road parcel (2004 –B)

                        The Board reviewed the Pope plans. Pope is looking for approval on an estate lot. He is also looking for a side setback variance. The board will hold a Public Hearing on March 10, 2004 to discuss Pope’s plans. Pete Leveque is the engineer and Smith Associates are the surveyors. Flynn advised showing the driveway and building envelope on the blueprint. Pope told the board he was going to file with the Town Clerk on February 12, 2004.

(2.) Public Hearing for Town Meeting Articles –

A date was set for March 10, 2004 at 7:00 for the Public Hearing on the articles for the Town Meeting. Majkut will not be present, but is comfortable with missing the meeting on the warrant issues on that date.

(3.) Mass Land Use reform Act –

            Discussion was held on sections of the Mass Use Reform Act.

(4.) Scantic Meadows –

            Flynn talked to Town Counsel Dave Martel about the contract. Flynn filed with the Town Clerk on February 2. Speight’s Attorney and Town Counsel are in talks about the contract. The revised “Notice of Finding and Decision Definitive Subdivision Plan Application” has been filed with the Town Clerk. Attachment #19, Tennessee Gas Pipeline requirements, was also filed with the Town Clerk. Flynn talked with Martel and had some concerns.  The twenty day appeal period will be up on February 22. The Board will know by the next meeting if there are any appeals.

(5.) Stormwater –

            Things are moving along. The big issue is the catch basins. What is the Town supposed to do with the refuse from the basins?

(6.) Driveway Permit-

            Majkut is working on the form and will e-mail Flynn a copy.

(7.) Sidewalk Committee:

            Flynn met with the Selectman about the sidewalk committee and there has been no action taken.
