TOWN OF HAMPDEN

The minutes of May 14 were accepted with the following addition: In Item (2) the fourth paragraph starting "Dolben made a motion..”. third line, add the word "maintenance" at the end of the line to read, "in both deeds to provide adequate enforcement of the driveway maintenance.”

(1) Appointment 7:05 Russ Braun East Longmeadow Rd PURD Proposal
Braun stated that he wanted to try to explain his understanding of density and net developable areas, which seem to be in conflict. He has discussed it with persons used to dealing with this issue and has a different interpretation of the text in the Zoning Bylaw.
Braun has 37 acres which he will split into one frontage lot that occupies part of the parcel and about 16 acres for the PURD. He pointed out that if a developer has land issues, the zoning as in place doesn't give a bonus to encourage the use of a PURD , except for the flexibility of layout. He feels that he has 9 acres of developable land and has a "ballpark" idea where the wetlands are. The Zoning states there can be no more units on the property than there could be a subdivision. He drew up two layouts - one using available land woth a given of no power line/no wetlands and had 1S lots. His drawing of reduced lots showed 13-14 lots. To make his project feasible he has a goal of building 22 units. Braun still has not filed for a Special permit as he is still in the exploration stage as a business man, to see if it should go.
Chair Flynn commented that since this is the second use of this type of zoning, the Board is still in the learning stage and maybe needs to come together more in view of the developers needs. He committed the Board into looking into "retooling" this section to make it more favorable. (7.13.4, 7.13.5 and 7.13.6)
(2) SOUTH RIDGE ESTATES - Bond Release, South Ridge Road
Clerk drafted a letter to T.P. Daley Insurance Agency noting that South Ridge Road was accepted for highway purposes on Oct. 21, 2002. Clerk also checked with the Town Engineer and all bills have been paid. The Board voted to release the bond and Chair endorsed the letter.
(3) ANR - SPECIAL PERMIT DECISION – Lot 2B South Rd
Clerk checked with Eva Wiseman, Tax Collector today and determined that Russ has not paid taxes from last Nov. on this lot. The Board voted to allow the Chair to endorse the plan and Decision Document tomorrow if the taxes are indeed paid. If not, the business will be carried over to the next meeting. (Note - Morton called Thursday AM and had a job to go to. but thanked Board for efforts and said it will be paid by the next meeting).
(4) SOUTH ROAD ABANDONMENT
Copy of Legal Notice, Town of Somers, denoting a vote to abandon "Old Hampden Road"/South Rd. extension was given to Chief hatch and the Selectmen. A reporter from the "Journal Inquirer" contacted the Board on the message tape to receive comment. No update has been received, but the Board will check into it.
(5) MEMBER PROJECTS
Ridgeline & Hillside
Check list for Thomas Gianetti was filed on May 8. Total clearing will be less than 1 acre.
Flynn will meet with Doug Farmer tomorrow to help him put together an article informing the public about this Bylaw and looking for potential committee members.
